Purchase Terms & Warranty

Standard terms for camper sales by Slide On Campers Limited.

These terms apply to the camper identified in the accompanying Slide On Campers (“SOC”) quote, order confirmation, deposit invoice or final invoice, and should be read alongside the separate Slide On Campers Handover & Owner Care Record (“Handover Record”) provided at or before collection. In placing an order for a camper the purchaser agrees to be bound by these terms.

1. Order and specification

The camper is a custom slide-on camper ordered and configured for the purchaser. The included equipment, options, price and any agreed freight or delivery arrangements are those shown in the accompanying Slide On Campers quote, invoice or written order specification.

The purchaser is responsible for confirming before paying the deposit that the camper is suitable for their vehicle, intended use and other requirements. SOC may rely on information supplied by the purchaser.

SOC is not responsible for any loss, damage, cost or delay arising from incomplete, inaccurate or late information supplied by or on behalf of the purchaser, including vehicle specifications, intended use, delivery requirements, finance arrangements or requested configuration.

Where availability, production, compliance or supplier changes require it, SOC may substitute a component with one of substantially equivalent specification, provided the substitution does not materially reduce the camper’s overall function.

Because the camper is custom-built to SOC’s specification and is not an off-the-shelf product, production and supply may depend on manufacturer availability and completion of specification, inspection, import and compliance steps.

2. Deposit, order acceptance and final payment

On placing an order, the purchaser must pay a 50% deposit unless SOC agrees otherwise in writing. Payment of the deposit confirms the purchaser’s acceptance of these terms and authorises SOC to place the factory order, procure components and incur production, import and compliance costs for the purchaser’s camper.

Unless SOC expressly confirms in writing that an order is conditional on finance, the order is not conditional on the purchaser obtaining finance. The purchaser is responsible for arranging any required finance before committing to the order.

The remaining balance of the purchase price (as set out in the purchase order) must be received in cleared funds before the camper is released or delivery is completed, with the Handover Record being completed on handover.

SOC may provide the purchaser with the purchase terms and warranty information with the deposit invoice. Following full payment being made to SOC, SOC shall deliver the camper to the purchaser in accordance with paragraph 5 below.

3. Cancellation by the purchaser

The deposit secures the purchaser’s order and SOC’s associated production, procurement and import commitments. Once SOC has accepted the order, committed to production or procurement or incurred associated costs, the deposit becomes non-refundable if the purchaser cancels due to a change of mind, inability to obtain finance (unless the order is still conditional on finance) or any other reason not attributable to any fault or breach by SOC.

SOC may apply the retained deposit toward factory and supplier commitments, freight and import costs, administration, storage, resale loss and other costs or losses incurred by SOC in connection with the purchaser’s order or its cancellation.

SOC is not required to refund any part of the deposit. If SOC’s costs and losses exceed the deposit paid, SOC may recover the shortfall from the purchaser.

4. Delivery, completion and collection

Any delivery, completion or handover date is an estimate unless SOC expressly confirms a fixed date in writing. Time is not of the essence.

Factory production delays, component or material shortages, supplier delays, shipping disruption, port congestion, customs clearance, transport delays, inspections, certification or regulatory requirements, adverse weather, local installation work, or other matter beyond SOC’s reasonable control may change the estimated date. SOC will take reasonable steps to keep the Purchaser informed of any material delay but is not liable for any loss arising from that delay.

If a completed camper is not collected or accepted when reasonably requested, SOC may charge the purchaser its reasonable storage, handling and re-delivery costs.

If SOC is prevented from, or materially delayed in, supplying the camper because of manufacturer or supplier failure, shipping disruption, an import restriction, a change in law or regulatory requirements, a force majeure event, or any other matter beyond SOC’s reasonable control, SOC may:

(a) extend the estimated delivery timeframe;
(b) offer the Purchaser a reasonably available alternative; or
(c) cancel the order by written notice.

If SOC cancels the order under (c) above, SOC will refund the amount paid by the Purchaser.

5. Handover, ownership and risk

Handover will be completed using the separate Slide On Campers Handover Record, covering operation, key safety information and owner-care requirements.

SOC will not release the camper until the full purchase price and all other agreed amounts are received by SOC in cleared funds.

Legal title and ownership passes to the purchaser only when:

(a) SOC has received the full purchase price and any other agreed amounts in cleared payment; and
(b) the camper has been released to the purchaser.

Risk of loss or damage passes to the purchaser when the purchaser, their representative or the purchaser’s nominated carrier takes possession, or where SOC has agreed to arrange delivery, when delivery is completed at the agreed delivery location.

Where the purchaser arranges collection, onward freight or other transport, the carrier acts as the purchaser’s agent. SOC is not responsible for the carrier’s delay, handling, acts or omissions, or for any loss or damage occurring after risk has passed.

The purchaser must inspect the camper at handover or collection or ensure that the purchaser’s representative or carrier does so. Any visible shortage, damage or other issue must be recorded in writing before the camper leaves SOC’s premises or control. If no issue is recorded, the camper will be treated as having been supplied in apparent good order and condition, except for any issue that could not reasonably have been identified during the inspection.

6. Vehicle, loading, mounting and tie-downs

The purchaser is responsible for ensuring and confirming that the vehicle used to carry the camper is legally compliant, mechanically and practically suitable for that purpose. The purchaser must ensure that the loaded vehicle complies with all applicable limits and requirements, including payload capacity, Gross Vehicle Mass, axle limits, wheel and tyre ratings, suspension and chassis limits, vehicle manufacturer requirements and the effect of passengers, fuel, water, LPG, accessories, tools, food, luggage and other loads. SOC may rely on the accuracy and completeness of any vehicle specifications, weights and information supplied by the purchaser.

The purchaser is responsible for supplying suitable tie-down equipment of the correct type, rating and condition, selecting suitable attachment points on their vehicle, determining how the tie-downs are attached to the vehicle, and installing, using, inspecting, adjusting, maintaining and replacing the tie-down equipment. The purchaser must reassess the tie-down setup if the vehicle, suspension, accessories, loading or camper configuration changes. A loading or tie-down demonstration does not certify the purchaser’s vehicle or any purchaser-supplied tie-down equipment.

SOC does not represent or warrant that any purchaser-supplied vehicle, tray, suspension component, mounting point, tie-down point, accessory or other equipment is suitable, safe, legally compliant or sufficient for carrying or securing the camper.

7. Owner care and required checks

The camper must be used, stored and maintained in accordance with the operating, safety and owner-care information supplied by SOC, the separate handover record, the owner’s manual, the warranty or service logbook and the instructions for installed equipment.

The purchaser is responsible for supplying a suitable LPG bottle and for its correct connection and use.

The purchaser must retain the owner’s manual, warranty or service logbook and all relevant maintenance, inspection and repair records, and must make those records available to SOC if a warranty claim is made.

Completion of the scheduled owner checks at approximately 3 months, 6 months, 9 months and shortly before 12 months after handover is a condition of the SOC 12-month voluntary warranty. The purchaser must keep the resulting digital records and promptly report any abnormal condition identified during a scheduled check or at any other time.

SOC may decline a voluntary warranty claim where a required check due before the claim was not completed, required maintenance records are unavailable, an abnormal condition was not promptly reported, or continued use materially affected the condition, diagnosis or extent of damage.

The purchaser indemnifies SOC for any claim, loss, damage, cost or expense arising from the purchaser’s vehicle, tie-down equipment, loading decisions, transport arrangements, storage conditions, misuse, unauthorised work, failure to maintain records, failure to follow instructions or failure to comply with these terms, except to the extent caused by SOC’s proven negligence or breach of law.

8. Modifications, third-party work and repairs

A purchaser modification or alteration voids the SOC 12-month voluntary warranty. Third-party repair, dismantling, sealing, wiring alteration or component replacement must also be approved by SOC in writing if voluntary warranty coverage or reimbursement is sought.

Electrical and gas work must be carried out by appropriately qualified persons where required.

If the purchaser arranges or authorises any third-party inspection, alteration, repair or other work without SOC’s prior written approval, the purchaser is responsible for that work and for any resulting effect on the camper’s legal compliance, safety, performance, watertightness, diagnosis, repairability or eligibility for cover under SOC’s voluntary warranty. The purchaser indemnifies SOC against any claim, loss, damage, cost or expense caused or contributed to by that third-party work.

9. 12-month SOC voluntary warranty

SOC provides the original purchaser shown on the sales invoice with a 12-month voluntary warranty from the date of handover against defects in materials or workmanship arising under normal recreational use, subject to the terms of the Handover Record being complied with by the purchaser (“voluntary warranty”).

The voluntary warranty is SOC’s only express warranty. All other warranties, guarantees, representations, conditions or obligations that may otherwise be implied are excluded or limited to the maximum extent permitted by law.

The voluntary warranty does not cover loss, damage or failure arising from:

  • fair wear and tear, routine servicing, maintenance, cleaning or adjustment;
  • accident, impact, theft, vandalism, misuse, abuse, neglect or use beyond supplied operating instructions;
  • commercial hire, rental or fleet use unless SOC has approved that use in writing;
  • vehicle overloading, unsuitable vehicle selection, incorrect loading, improper mounting, incorrect tie-down use, inadequate tie-down rating or condition, or failure of purchaser-supplied tie-down equipment;
  • failure to complete required owner checks, maintenance or reporting obligations;
  • water ingress or deterioration associated with external damage, neglected seals or joins, unapproved penetrations, improper storage, pressure washing or failure to act on visible moisture or deterioration;
  • prolonged dampness, trapped moisture, wet canvas left packed away, inadequate drying or unreasonable storage conditions;
  • battery or electrical damage arising from charging, storage or use contrary to supplied instructions, reversed polarity, unauthorised wiring or electrical alterations;
  • insects, rodents, vermin, environmental contamination, corrosion or deterioration caused by inadequate care;
  • unapproved repairs, sealants, adhesives, cleaning products, lubricants, drilling, cutting, penetrations, alterations or aftermarket installations;
  • continued use after a significant abnormal condition became apparent where continued use worsened the condition or damage;
  • any defect, damage or performance issue caused or contributed to by purchaser-supplied equipment, aftermarket accessories, vehicle movement, road conditions, off-road use beyond the camper’s intended recreational use, overloading, failure to secure items or inadequate ventilation;
  • cosmetic variation, minor finish differences, supplier model changes, manufacturing tolerances, component substitutions or other matters that do not materially affect the camper’s safe recreational use; or
  • any matter caused or contributed to by failure to mitigate loss, failure to give SOC a reasonable opportunity to assess the issue, or failure to follow SOC’s reasonable directions.

The SOC voluntary warranty is provided to the original purchaser only and is not transferable or assignable unless SOC agrees in writing.

Repair, replacement or remedial work carried out under the voluntary warranty does not restart or extend the original 12-month warranty period unless otherwise required by law.

Where a component is covered by a separate manufacturer, supplier or installer warranty, SOC may require the purchaser to follow the applicable claim process or may assist with that process where SOC considers it appropriate.

10. Warranty claims and assessment

In order for the voluntary warranty to apply the purchaser must report a claim to SOC in writing promptly after the issue is discovered and no later than 7 days of the purchaser becoming aware of the defect. The purchaser must provide the sales reference, a description of the issue, photographs or video where requested, and the relevant Handover Record and owner-care and maintenance records.

The purchaser must make the camper reasonably available for assessment by SOC or an approved repairer. No permanent repair, dismantling, sealant work, wiring alteration or component replacement is to be undertaken by a third party without SOC’s prior written approval where voluntary warranty coverage or reimbursement is sought.

SOC will assess the claim against these warranty terms. Where a claim is accepted, SOC may choose to repair the affected item, replace it with the same or a reasonably equivalent item, or arrange approved remedial work through SOC or an authorised repairer.

Unless SOC agrees otherwise in writing, the voluntary warranty does not reimburse transport of the camper, travel, accommodation, storage, loss of use, lost income or other incidental costs. SOC is not responsible under the voluntary warranty for unauthorised third-party repair costs.

If an inspection shows that the issue is not covered by the voluntary warranty, SOC may charge reasonable inspection or diagnostic costs where that charge was advised before the inspection.

The warranty assessment may take into account whether the camper has been properly maintained, whether scheduled checks and logbook requirements have been completed, whether any issue was promptly reported, and whether the purchaser continued to use the camper after becoming aware of an abnormal condition.

11. Limitation of Liability

Nothing in these terms excludes, restricts or modifies any right, guarantee, remedy or liability under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other applicable law where that right, guarantee, remedy or liability cannot lawfully be excluded, restricted or modified.

Subject to SOC’s obligations under relevant law from time to time:

(a) SOC’s liability is limited to the remedies expressly provided in these terms;
(b) SOC is not liable for any indirect, consequential or special loss, loss of use, loss of income or profit, inconvenience, or travel, accommodation, storage or other incidental costs arising out of or in connection with the purchase, delay, transport, delivery, handover, use, assessment or repair of the camper; and
(c) SOC’s total aggregate liability arising out of or in connection with the order, camper, delivery, handover, warranty, use, assessment, repair or any related matter is limited to the amount actually paid to SOC for the camper giving rise to the claim.

In respect of any claim that is not covered by the voluntary warranty, the purchaser must notify SOC in writing, including the relevant facts and available supporting information, as soon as reasonably practicable after becoming aware of the matter. The purchaser must take reasonable steps to avoid or minimise any loss, damage or cost arising from the relevant matter.

Where the purchaser acquires the product in trade, both SOC and the purchaser are in trade, and the product is acquired for business purposes, the parties agree that the Consumer Guarantees Act 1993 does not apply to the supply, and that sections 9, 12A, 13 and 14(1) of the Fair Trading Act 1986 do not apply.

The parties acknowledge that they consider it fair and reasonable to be bound by this limitation of liability having regard to the nature and value of the transaction, their respective bargaining positions and all other relevant circumstances.

12. General

The quote, invoice or written order specification and these terms together form the sale terms. If there is an inconsistency, the most recent written order confirmation takes precedence in respect of the agreed camper specification, options, price and delivery arrangements, while these terms continue to govern the general sale and voluntary warranty terms.

Unless otherwise required by law, no statement, estimate, photograph, brochure, website description, social media post, discussion or other representation forms part of the contract unless it is expressly incorporated into the written order specification or otherwise confirmed in writing by SOC.

Any agreed variation to the order or these terms must be confirmed in writing by SOC. Written communication includes email and other electronic communication used between SOC and the purchaser.

SOC will provide available compliance documents relevant to the camper, which may include self-containment certification, gas certification and electrical warrant information. The purchaser is responsible for keeping those documents with the camper and complying with any renewal, use or owner obligations that apply after handover.

A failure or delay by SOC in enforcing a term does not waive SOC’s right to enforce that term later. If any provision is found to be invalid or unenforceable, the remaining provisions continue in effect.

SOC may carry out handover, assessment, repair or remedial work through an authorised contractor or repairer.

The purchaser must pay SOC’s reasonable costs of recovering unpaid amounts, enforcing these terms, responding to unfounded claims, storing or preserving the camper, arranging re-delivery or dealing with purchaser-caused delay, default or cancellation, including legal costs on a solicitor-client basis.

The purchaser may not set off, deduct or withhold any amount claimed to be owing by SOC unless otherwise agreed by SOC.

New Zealand law applies to these terms.
